Hong Kong Statutory Annual Leave Calculator

I am on probation or working part-time — do I still get statutory annual leave?

Probation counts toward continuous service — the same ladder applies. Part-time workers qualify so long as they work at least 18 hours a week for at least 4 consecutive weeks (the "4-18 rule"). If your hours or weeks fall below that threshold the contract is not a continuous one, so there is no statutory leave obligation, though your contract can still provide more.

How soon can I actually take my first day of leave?

The 7-day entitlement is earned after 12 months of continuous service, and the employer must allow it to be taken within the following 12 months — it cannot be deferred indefinitely. In practice your manager will schedule it during the second year. If you leave before the new year resets, any unused days are paid out pro-rata.

Can my employer pay me out instead of giving the leave?

Only the portion above 10 days can be paid out in lieu — i.e. you must take at least 10 actual days off, which only becomes relevant once you cross into the 10-day tier (year 5). On termination, any untaken statutory leave must be paid out at the average daily wage; the employer cannot simply wipe it.

I have 12 years of service but still only 14 days — is that low?

Yes — 14 is the statutory ceiling, so even 30 years of service still gives the same number. But 14 is the legal floor only; many private employers (banks, MNCs, professional firms) grant 20–25 days from day one and add more with seniority. If your contract sits at the statutory minimum, comparing it to market norms in your industry is a fair conversation to have with HR.
