Should I use 260 working days or 365 calendar days?
Follow the contract / staff handbook. The general patterns: (1) salaried office roles → working-day basis (260 or 261), because the employee only ever has ~ 260 paid working days per year anyway; (2) day-rate / casual / contract workers → 365 (or 366) calendar days, because off-days are unpaid by definition; (3) "industry day" finance contracts → 252 trading days. Numerical impact: $60,000 annual × 30 days worked: $6,923 on the 260 basis vs $4,932 on the 365 basis — ~ 40% difference; picking the wrong basis is a common dispute trigger.
A new hire starts April 15 on a $84,000 salary — what do they earn this year?
Step 1: count working days from April 15 to year-end — roughly 8.5 months × ~ 21.7 working days ≈ 184. Step 2: use the 260 working-day basis (standard salaried setup). Step 3: prorated = 84,000 × 184 ⁄ 260 = $59,446. Calendar-day variant: April 15 → Dec 31 = 261 calendar days; prorated = 84,000 × 261 ⁄ 365 = $60,066 — close but not identical. Real HR settlement will then layer on: first paycheck split as semi-month or pay-period prorate; federal / state withholding, social security, 401(k); benefits waiting periods. How should paid vs unpaid leave be handled?
Paid leave (statutory annual leave, public holidays, contractually paid sick leave) — do nothing; the full monthly salary still flows. Unpaid leave (unpaid personal leave, leave-of-absence, sick leave that has exhausted the paid cap) — deduct using the tool with the basis you would for hires (typically 260). Example: $78,000 salary, 5 days unpaid leave, 260 basis: deduction = 78,000 × 5 ⁄ 260 = $1,500. Using a 365 basis would deduct less (78,000 × 5 ⁄ 365 = $1,068) — better for the employee, worse for the employer; the dispute usually traces back to the contract not specifying which basis applies to unpaid leave.
